ADA lawsuit defense is every property owner's worst nightmare. At least with a fire there's insurance money to pay for it, right? But ADA defense claim is all on your dime. After you've finished cursing and throwing the plaintiff's complaint across the room, time to call a lawyer and make important business decisions.
We recently hired attorney Nolan Klein of the Law Offices of Nolan Klein, P.A. to handle the defense of an ADA (Americans with Disabilities Act) claim in Florida against one of our properties in Broward County. We went with Nolan Klein because after some research we learned that he has a great reputation in the ADA defense lawyer community. We learned he's even spoken to legislative bodies about ADA. Because he handles so many ADA defense cases, he has great insight into how ADA defense cases typically resolve, and importantly, how to avoid future ADA problems.
Most importantly, he spoke with us about our ADA defense in terms of a business problem, and guided us to resolving our ADA defense like any other business problem looking at risk and reward. He put together a plan of action for our ADA defense, and he implemented it flawlessly. He pushed on the plaintiff when he needed to, but did a great job of not turning our ADA defense into World War III and wrapping it all up for much less cost than we had feared. It was clear to us that because he had dealt with that particular ADA plaintiff attorney before, he knew exactly how our ADA case could be resolved effectively.
I know of so many other property owners who went with other attorneys and their ADA defense turned into nightmarish quagmire of legal fees and construction expenses. We did interview other ADA defense attorneys before going with Nolan Klein, and frankly many of them wanted to charge more money despite them having less ADA defense experience. They left us feeling like we'd be "just another file" for them, whereas Nolan took the time during the consultation to get to know us and our situation, and immediately start plotting a course to get things done. So we hired him and were thrilled with the result. Whether by email or phone, responses were always quick and he was proactive with our case.
Again, I feel your pain and anger about needing an ADA defense lawyer. Everyone knows the law needs reform but that won't help you right now. My advice is to be smart and hire Nolan to handle your case. Going with a "generalist" attorney is probably not going to work out for you as well as using someone like Nolan who focuses heavily on being a great ADA defense attorney.
