I have known Mr. Charlip since he became my litigation attorney in representation regarding my Case No.414-0066 Cace 08-040983 We sued the Greenberg firm and Barnett for malicious prosecution and wrongful eviction. On October 2010, I hired Mr. Charlip to present me on foreclosure because he was knowledgeable about RESPA & TILA rights and foreclosures. After he did a detailed forensic on my mortgage documents and discovered that the documents are toxic.
He started fighting the predatory lenders for 5 years until the lower court gave the final judgment to the predatory lender on May 2015.
But Mr. David Charlip could not rest because he believed that the judgment was not fair. He appealed to the Florida Supreme Court where the foreclosure was reverse and direct judgment in favor of the appellant dismissing the foreclosure on the mortgage for failure of the appellee (predatory lender) to prove its standing.
Mr. David Charlip got my house back and the banks reimbursed me for all my lawyer fees and cost for the last 5 years. And Mr. David Charlip is still fighting the civil lawsuit against the predatory lender for all the suffering, pain and embarrassments the caused my family.
Thankfully Florida courts have begun to catch onto this little trick by more stringently requiring banks to provide evidence that they owned the note and mortgage at the date of the filing of the complaint.
