I enlisted their services in June, 2019, on a boundary/easement dispute. Meetings/e mails continued and I finally met with their litigator who explained costs and stages of litigation to expect if I wanted to continue to pursue the action I initiated.
I said I understood and wanted to continue. I received a letter from the litigator I met with in August that said since the lawsuit was continuing, Smith and Malek would no longer be able to represent me due to not having the “capacity” to do so. Referrals were suggested, but after being current with my statements and accepting all their recommendations, I feel I was charged to pursue actions that were never further pursued. No money was returned. If you become a client, make sure you get a guarantee that they will not end your relationship because of the lack of “capacity”.
