I was pleased with the whole process, the outcome, and the cost.
In short, Brad's firm sued me for not paying my bill. I didn't pay my bill because I noticed I was billed for a court appearance that didn't happen and refused to pay. This prompted me to closely examine my billing. I noticed a LOT of discrepancies, so I counter sued, and I won. The court ordered the firm of Stahancyk, Kent & Hook to pay me. I've seen two other clients billings, one from 2006, and one from 2014 (mine was 2007-2009) and they had the same kind of "inappropriate billing" (according to the court).
If you were a client of Brad Miller or Stahahcyk, Kent & Hook, look for cover letters saying something like, "Enclosed are documents from someone. Please let me know if you have questions". Then compare it to the billing and you'll notice that you were charged .3/hour by Brad (or whatever attorney wrote the letter). In my case, in 2008 the amount billed for JUST the cover letter was $48. This also happened with Laurel Hook, a named partner and I was charged $90 for the same kind of cover letter. On a couple occasions, Hook had a clerk write the letter and bill it to Hook.
According to the Multnomah County Court, this is "inappropriate billing". The court found, "The billing records contain multiple instances of similar charges for cover letters or for activities associated with only a negligible amount of activity, chiefly reviewing incoming correspondence such as routine notices from the court." Also, "Sending a cover letter when forwarding copies of documents is a clerical activity. It does not require legal skill and, even if performed by a lawyer, is not appropriately billed as a legal service." Also, "In other instances the legal services engaged in are so clearly de minimus that I do not believe it would be within the contemplation of an ordinary consumer of legal services that they would merit a separate charge."
I filed multiple complaints through the Oregon State Bar about this and other seemingly unethical behavior. After four years, Ms. Hook was given a Diversion Agreement, the equivalent to a slap on the wrist, and it won't go on her record, so future clients won't know about it. So far, Brad Miller has been protected by the Bar. That...I'm still working on and I will prevail in the end.
This kind of actions by attorneys hurt people and families...and it makes the lawyers rich.
Please, if this has happened to you, request the "Karr file" from the Oregon State Bar and see for yourself what happened to me and my family. Then check your records and see if it happened to you. If it did, file a complaint with the Bar, feel free to use my complaint as a guide.
