I retained this firm in August 2016 for a commercial litigation case, alleging breach of contract, fraud, negligence, theft, DTPA. I was impressed with Mark Haney and would recommend him - he offered to walk over to the court to show me how it is set up, and showed me on his computer screens how they present items to a jury, and seems smart. He was a past president of the Tarrant County Trial Lawyers Association..
His partner Kelly Puls, is the smiley, friendly one, but in my experience was an outright crook. 1. He quoted a $100,00 fixed fee, then when he gave me the contract to sign it said $150,000. 2. I asked what happens if a defendant files for bankruptcy so this ends quickly and I recall he laughed and said "Then WE win!", i.e. he was hoping to get the better of me. 3. His contract allowed them to terminate - and keep my money - if I ever didn't follow their advice, and I expect they would have advised me to take a settlement offer for $56,000 and if I did not they would have kept my $100,000. 4. I told them to change it to hourly billing, and the first bill: a) billed one item twice, b) billed about 14 hours to prepare for a hearing on a motion for substitution, which requires no preparation, and had been cancelled two days before, c) billed 4 hours to strategize about an expert when I already had the best one in the country, and more. Almost all of the charges I questioned were by Puls, not Haney. Puls defended the invoice, which was described as "finalized," for four days, then finally, probably seeing he wasn't going to win, switched to saying "Aw shucks, it was just a draft that should not have been sent out." and insisting that instead of sending him a long email and spreadsheet documenting every one of the problems why didn't I just call? He offered to reduce it, but I insisted he send me a correct invoice, and was eager to pay the correct amount. He utterly refused, perhaps to avoid there being proof of all of the overcharges.. I fired them, and they gave me all my money back. Overall it was a complete waste of my time.
Again, though, Haney seems great, and offered good advice, and so if you can avoid avoid having anything to do with Puls, you might be ok.
