Financial Abuse or Exploitation: the illegal, unauthorized, or improper use of an older individual’s resources by a caregiver or other person in a trusting relationship, for the benefit of someone other than the older individual. This includes depriving an older person of rightful access to, information about, or use of, personal benefits, resources, belongings, or assets. Examples include forgery, misuse or theft of money or possessions; use of coercion or deception to surrender finances or property; or improper use of guardianship or power of attorney.

The Older Americans Act of 2006 defines elder financial abuse, or financial exploitation, as “the fraudulent or otherwise illegal, unauthorized, or improper act or process of an individual, including a caregiver or FIDUCIARY, that uses the resources of an older individual for monetary or personal benefit, profit, or gain, or that results in depriving an older individual of rightful access to, or use of, benefits, resources, belongings, or assets.”[1]

Tactics involved in financial elder abuse include the unauthorized use of an older person’s assets, gaining power of attorney by way of trickery, or engaging in fraud.

Had a health care surrogate papers drawn up for 18 year old son. Nobody ever thinks when your children turn 18 that maybe they can't speak for themselves in the future because of an accident but this is something good to have if they're not married. Having his wishes and at least two people on it. Very efficient been our estate family lawyer for 8 years with Will's in living trust. Would highly recomend her.
