I was a participant in a tricky real estate deal that involved an estate, cloudy title and a host of other non-typical legal issues. I was introduced to D&M through a friend and I am eternally grateful for the introduction. Scott Carter repped me on a number of deal issues and Ryan Featherstone repped me on the real estate issues. Being out of state we felt at a bit of a disadvantage with all "closing" details. Dunlap and Moran, PA staff were professional, punctual, deliberate, thorough, available and diligent. Our closing went without a hitch due in large measure to the exemplary conduct of Attorney Ryan Featherstone and his assistant, Marlene Daniels. All below observed actions and behaviors show incompetence, unprofessional behavior, and inability to communicate effectively: Stephanie Brannan sent the closing documents very late and very close to the closing date, not giving adequate time to allow for a closing. We received closing documents via email on November 12th (a Saturday) via email while in NZ demanding that we return them before November 16th, giving us less than four days, over a weekend, to address these documents. Stephanie communicated to us on 10/13 that we would not be able to pay off the PenFed mortgage associated with the property as part of the closing. Imagine our surprise, when we reviewed the closing documents, to see the PenFed mortgage payoff on there with no communication from Stephanie as to why it was now included. It is was really unacceptable and unprofessional to not communicate that the PenFed mortgage was being paid off. We spent a lot of time via conference calls and multiple emails with our 1031x agents to discuss how to handle this and stopped just short of having additional paperwork drawn up and an additional fee charged for them to handle the PenFed mortgage for us. We also had line item budgets drawn out with our architect, CPA and contractors for the proceeds of Albert Pl for our rental property construction in Denver that we will now have to redo. Stephanie could have saved us a lot of time had she told us that she were paying it off via the Albert Pl sale. Stephanie was told on 10/6 that we would be out of the country during the month of November and during this closing. She failed to communicate with us on closing a property abroad and sent us no information, instructions, tips or directions for closing a property abroad. She never told us that we would need to have any of the documents notarized with two witnesses, and in a follow-up email (after the fact) she made the dangerous assumption that we would be near an embassy, which was not the case. Plus, you need to make an appointment to have a notary meeting at an embassy, even if we were able to travel to one, and we checked and no appointments were available on our travel dates. The impact of her lack of communication is a failed closing on the scheduled date. Stephanie failed to communicate the fact that we were no longer able to close on 11/16 to everyone involved in the transaction, namely our 1031x company that was waiting on the funds to pay an architect, surveyor and contractor. Stephanie falsly claimed that she did contact the 1031 company on the day we emailed her after our 1031x company reached out to us confused as to why they did not receive the funding The 1031x company said that she didn't email them until after I emailed Stephanie concerned as to why she hadn't kept them up-to-date. The impact is that we now have to pay thousands of dollars out of pocket to pay these bills personally, something we do not have the funding for. Stephanie sent us four emails asking us to print and replace pages in our closing docs with other pages within a period of five days. We requested on 11/21 that she send us one concise email with ALL of the documents that need to be printed and signed, which is what she should have done from the start. Sending us multiple emails asking us to replace x with y, y with z, a with b and so on is asking for a mistake to happen and the wrong paperwork to be signed and sent in. This includes one of her last emails that was very unclear asking us to replace "the attached with the attached." On 11/16 we sent Stephanie and our agent an email asking for accountability and a response to all of the above issues. After no response was received, follow-up emails were sent on 11/21 (she said she would get back to us and "Advise") and 11/22 (morning) and 11/22 (afternoon) after she sent us an unrelated email without responding to the other two.
